Environmental and ESG Law

We are specialists in the field Polish and EU environmental law, natural resources, and Environmental, Social and Governance (ESG) regulations. For many years, we have received top honours in Polish and international legal rankings published by Chambers and Partners, The Legal 500 and the Rzeczpospolita daily.

We advise clients on the regulatory issues, project development and environmental aspects of real estate transactions, M&A transactions and financing processes. We provide comprehensive advice on investment processes. We have worked on a number of projects that involved the coordinated efforts of international environmental and ESG teams. We take an interdisciplinary approach to environmental and ESG issues, combining our forces with other non-legal advisors when necessary. We regularly monitor the European Green Deal and ESG regulations to keep our clients fully up to speed of any developments related thereto. We also cooperate with a number of bodies working on regulatory projects (e.g. EFRAG).

For years, our lawyers have successfully represented clients in administrative and judicial proceedings concerning environmental law. Our attorneys advise companies in the energy, renewable energy, chemical, construction, waste management, FMCG, heavy industry, manufacturing, water and sewage, mining, automotive, apparel, real estate, and food sectors.

Our experience in environmental law focuses on:

  • climate protection (including EU ETS, CBAM, the legal requirements for the determination of a carbon footprint, carbon offsets);
  • emissions (including theLCPD, the MCPD and the BAT Conclusions);
  • waste (including by-products, end of waste, landfills, recycling, international waste transport, waste to energy, the deposit and return scheme, batteries and the PPWR);
  • water management;
  • investment process (including EIA permits and nature protection);
  • environmental permits for operations (including integrated permits);
  • soil, land and water contamination;
  • environmental requirements for products (including  eco-design directive) and chemical regulations;
  • noise; and
  • nuclear law.

In the ESG field, we help clients:

  • identify new regulatory challenges concerning ESG issues (concerning, among others, the European Green Deal, the CSRD, the ESRS, Taxonomy, the CSDD and deforestation);
  • determine how to approach upcoming regulatory requirements;
  • prepare for sustainability reporting, manage the value chain and avoid greenwashing;
  • develop new products and implement investment projects to decarbonise and green a business; and
  • conduct green financing.

Having a wide range of reputable lawyers from different areas, we are able to comprehensively guide clients through their transformation to net zero in the spirit of the European Green Deal and ESG.
