Łukasz Żak

Łukasz Żak is an advocate admitted to practice in Poland and a partner in the dispute resolution department of Rymarz Zdort Maruta.

Experience and education:

A specialist in litigation, including civil, corporate and commercial law matters, his areas of practice comprise, in particular, the pursuit of claims stemming from breaches of commercial and construction contracts, post-M&A disputes related to contractual representations and warranties, and corporate disputes concerning resolutions of meetings of shareholders and related to the liability of members of the governing bodies of commercial companies. He has substantial expertise in securing claims for damages and compensation. Łukasz’s litigation experience includes, in particular, representing the Polish national railway company in various disputes regarding the breach of a commercial contract valued at over PLN 50 million, representing one of the largest Polish energy companies in connection with a construction dispute with a consortium of contractors valued at over PLN 100 million, advising one of the leading construction groups in Poland and the general contractor in connection with alleged construction defects in an airport runway, representing a private equity investor in a dispute with the former owner and CEO of a renowned beauty clinic, representing the majority shareholders of a leading producer of mineral water in Poland in a dispute with a former shareholder of the company, and representing the State Treasury of the Republic of Poland in a dispute regarding false representations and warranties given in a share purchase agreement.

He also has extensive experience in representing clients in domestic arbitration, in particular regarding various post-M&A disputes. He recently advised a leading Polish food and consumer goods company in administered expert proceedings before the International Chamber of Commerce (ICC) as well as has represented clients in various arbitral proceedings before the Court of Arbitration at the Polish Chamber of Commerce in Warsaw (KIG).

Łukasz Żak has also successfully represented clients during out-of-court mediation proceedings, including in relation to post-M&A disputes, real estate sale claims and a number of construction disputes.

He graduated with distinction from the Faculty of Law and Administration of the University of Warsaw in 1999, joined the law firm in the same year and qualified as an advocate in 2003.
